The following sections on this page cover our Agency Fees, Refund Policy and Scale of Rebate:
Should the Client before the expiry of 6 weeks terminate the employment, the fee will be refunded in accordance with the accompanying Scale of Rebate – only in the following circumstances:
No refund will be payable where the Client requests that no replacement be found. No refund is available where the Client makes other arrangements during the period in which the replacement is sought. Should the client subsequently re-engage the candidate within the period of six calendar months from the date of termination, a full fee becomes payable.
In the case of a Maternity placement, if an employee fails to take up her duties and a suitable replacement is not found within 1 month of the contract commencement date – a full refund of agency placement fees will be made. Where a birth occurs before the booked date, and a chosen maternity nurse is unable to fulfil either, all or part of the placement and the agency is unable to offer a replacement – a refund of placement fees will be calculated based on the contract time unfulfilled. In the case of miscarriage – a full refund of placement fees will be made and no payment is due to the maternity nurse. In the case of a still birth – a full refund of placement fees will be made. Payment to the maternity nurse is at her discretion. No refund will be payable where the Client requests that no replacement be found. No refund is available where the Client makes other arrangements during the period in which the replacement is sought.
The Company endeavours to ensure the suitability of any candidate introduced to the Client. The Client shall not withstanding satisfy his/herself as to the suitability of any candidate and shall take up any references provided by any applicant and the company before engaging such applicant. The Client shall be responsible for obtaining work permits, for the arrangements of medical examinations and or investigations into the medical history of any candidate, and to ensure that any medical and other requirements or qualifications by the law. The Client is responsible for the employee’s tax and PRSI contributions and in addition employer PRSI that is required by law. With the exception that Maternity Nurses are self employed and shall be responsible for Revenue and Social Welfare contributions.
The Company does not accept responsibility for any loss or damage resulting from an introduction by the Company or their provision of services or from the acts, omissions or conduct of such introductions.
In the event of a Client making a cancellation within a period of 2 weeks from the agreed commencement date, after agreeing to employ personnel, a full fee will become due. 50% of this fee will be paid to the candidate as compensation for loss of earnings.
The Client should reimburse all reasonable travelling expenses incurred by potential employees who present themselves for interview, either travelling to Dublin or travelling outside of Dublin.
In the case of Maternity Nurse placements, an additional full fee will be charged to the Client when employees return for any further terms of employment.
In the case of Overseas Clients, the Client is responsible for obtaining a work permit, satisfying any tax, medical or legal requirements, qualifications etc, that are required by the employment laws in the country where employment takes place.
An invoice will be raised on acceptance by the candidate of the engagement offer. Payment of the Agency fee is due within 7 days of the invoice date and before the candidate commences employment, failure to do so may result in the employment offer being cancelled. In the case of overseas placements, payment is due seven days prior to the departure date of the employee.
In respect of all staff, the company acts as an introducing agent only and does not directly or indirectly employ staff. Irish Law governs these terms of business and all disputes arising out of or in connection therewith shall be subject to the jurisdiction of the Irish courts. |
